This Website is owned and operated by Kōdō Atelier (ABN 23846245431), trading as Kōdō.

The following Terms and Conditions govern the use of the Kōdō Website ("Site"), the materials and information contained therein and related services made available to you via this Site. If you do not agree to these Terms and Conditions, please do not visit or use the Site. Kōdō may from time to time change this Site (including these Terms & Conditions of use). Please read these Terms and Conditions and re-read before subsequent use.

Kōdō, its representatives and associated agents are not liable to you or any other for any loss in connection with the use of this Site or a Linked Website. This general disclaimer is not restricted or modified by any of the following specific warnings and disclaimers.

Kōdō assumes no responsibility for, and makes no representations to you or any other person with respect to the accuracy of the information on this Site. You will be required to register to use some of the features on this Site. We may change registration requirements from time to time and without notice. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. All trademarks, brands and names appearing on this Site are the property of their respective owners.
Nothing contained on this Site should be construed as granting any license or right of use of any trade mark or part of any trade mark displayed on the Site without the express written permission of Kōdō or third party owner.

YOUR ACTIVITY
You use this Site at your sole risk. You agree that you will be personally responsible for your use of this Site and for all of your communication and activity on this Site. We reserve the right to deny you access to this Site, or any part of this Site, at any time without notice. If we determine, in our sole discretion, that you engaged in prohibited activities, were not respectful of other users, or otherwise violated the Terms and Conditions, we may deny you access to this Site on a temporary or permanent basis and any decision to do so is final.

PROMOTIONAL CODES
Promotional codes must be used at the time of purchase. We are unable to apply a promotional code to an existing order in retrospect. Promotional codes have issue and end dates. You must use your promotional code within the specified time frame. Promotional codes cannot be used on Gift Voucher purchases.

DELIVERY
Please ensure that the shipping address details provided for your order are correct. Kōdō is not responsible for incorrect addresses, refused shipments, or unclaimed parcels. Parcels returned to Kōdō by Australia Post for any reason will be subject to a returned charge of $15 and a resending fee of $10.

LINKS AND THIRD PARTY REPRESENTATION ON THIS WEBSITE
Kōdō makes no representations or warranties about any other website which you may access through this Site (“Other Website”). When you access an Other Website, that Other Website is independent from this Site, and Kōdō has no control over the content on that Other Website. Any link to an Other Website is provided as a convenience to users of this Site. Other Websites are not under the control of Kōdō, and Kōdō is not responsible for the accuracy of any information on any Other Website. Kōdō does not monitor or review the content of any Other Website. You must take your own precautions to ensure that any Other Website that you access by link from this Site is free from viruses, worms, trojan horses and other material of a destructive nature.
Kōdō expressly disclaims any liability to you for all Third Party Posted Material. GOVERNING LAW
These Terms and Conditions are governed by the laws in force in New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and any courts which may hear appeals from those courts.
Nothing contained in these Terms and Conditions derogates from Kōdō’s right to comply with law enforcement requests or requirements relating to your use of this Site or information provided to or gathered by Kōdō with respect to that use.

IN GENERAL
In this Site:  Kōdō means Kōdō Atelier (ABN 23846245431), trading as Kōdō Atelier and its subsidiaries, associates and officers unless otherwise stated.
"Other Website" means websites of persons or entities other than Kōdō which are linked to and from this Site.
"Your Information" means any information from which your identity is apparent or can be reasonably ascertained. "Site" or "Website" means the whole or any part of the web pages located at www.kodo-atelier.com.au (accessed via www.kodo-atelier.com.au) including the layout of this Site, individual elements of the Site design, underlying code elements of this Site, or text, sounds, graphics, animated elements or any other content of this Site.
"We" and "us" refer to Kōdō, and "our" has the same meaning.
"Third Parties" means persons or entities represented on the Site other than Kōdō.
"Third Party Posted Material" means posted statements, information relating to items or items offered for sale by Third Parties on some portion of this Site.

DELIVERY & RETURNS
Before our products are shipped each item is carefully inspected and packaged so that it arrives to you in perfect condition. All parcels in Australia are shipped via Australia Post to ensure that your purchase is delivered as quickly and as safely as possible.
This Shipping policy forms part of the Kōdō website terms and conditions.

SHIPPING CHARGES
Shipping charges are calculated within the shopping cart. Simply add a product to your shopping cart and select your destination. Your shipping price and approximate delivery timeframe will be displayed. Shipping is calculated at the end of your transaction.
Important: If you are not at the address supplied when our Australia Post partners attempts delivery it is your responsibility to organise the pickup or redelivery of your order within 7 days. For information on your delivery always check the tracking information provided and if you have any questions please contact Kōdō at orders@kodo-atelier.com.au

INSURANCE
Your products are insured against loss while in transit to you. Once the parcel has been received (all packages require a signature as acceptance) the goods are deemed your responsibility and insurance from Kōdō ceases. It is expected that if an item needs to be returned to Kōdō that insurance be placed on the item/s whilst in transit.

WHEN WE SHIP
In-stock products that are purchased on weekdays before 2 pm will be dispatched the next business day.

DELIVERY TIMES
All orders are shipped by Australia Post. Orders received before 2 pm each day will ship the very same day and be scheduled for delivery within two to six business days for all free shipping orders. We try hard to ship in the times quoted and faster if possible‚ but sometimes deliveries can be delayed beyond our control. When your product is dispatched you will receive an email containing a consignment number and tracking instructions. This number will allow you to track the progress of your parcel.
Please note that parcels shipped to remote areas may take an additional day to deliver. Please email orders@kodo-atelier.com.au for further details. To avoid delays in receiving your parcel, we suggest that you have the item delivered to an address where someone will be available to sign for it. Best to use a work address so you get it quickly. PO Boxes are accepted.

INTERNATIONAL DELIVERY
Kōdō offers express shipping to most countries. All international orders incur a flat rate of $49. This includes both trackable and non-trackable shipping services, depending on your location.
This covers transportation charges only.
Depending on an order’s final destination, we expect delivery to take between 4 - 7 business days. On occasion, parcels may be held up in customs which can lead to delays in delivery.
We do our best to ensure quick delivery but do not take responsibility for any delays and extra fees which may be incurred via customs and duties offices in other countries.
Please be aware that once an order has been booked and packed, it is not possible to redirect or cancel shipments.
For further information on customs and duties, we recommend contacting your local customs office.

RETURNS & EXCHANGES
Change of Mind
If you've had a change of heart about an item you have ordered, we'll need to receive it back to us unopened and unused, in the original packaging.

FAULTY PRODUCTS
Items are carefully inspected and packaged before they are shipped. Damage occurring en route is highly unlikely however should this occur please contact us as soon as possible. Keep all of the original packing material and we’ll provide you with instructions. We’ll investigate the fault or damage immediately.
We require you to: 1. Contact us to report the fault within 2 days. All returns must be authorised by Kōdō Customer Service. 

2. Provide proof of purchase. 

3. We’ll supply you with instructions and investigate the fault or damage immediately. 

4. We will organise the return of the faulty or damaged product to Kōdō. Please note that products must be returned to us in their original condition and in their original packaging. Products must not have been opened or used. 

5. Please note that refunds will be processed using the original payment method. 

6. All returns and exchanges are subject to our terms and conditions. 

7. Non-faulty products: exchange or Kōdō credit only. Please choose your purchase carefully as Kōdō does not provide a refund in this case. Kōdō does however provide exchanges or alternatively a credit to use through the Kōdō website at a later date.
For an exchange or a credit on a product we require you to: 

1. Contact us via email orders@kodo-atelier.com.au to report the need to exchange the product within 7 days. All returns must be authorised by Kōdō Customer Service. 

2. Provide proof of purchase. 

3. We’ll supply you with a return authority and instructions on how to return the product. The item must be returned to Kōdō within 7 days of the return authority. Please note that you are responsible for returning the product to Kōdō and all charges incurred are at your expense. It is a requirement that the items be sent using Registered Post with the appropriate insurance to ensure the items are secure in transit. 

4. Upon receiving the product it will be inspected to ensure that it hasn't been opened. Products must be returned to Kōdō in their original condition and in their original packaging. 

5. Once the return has been processed you will either be supplied with the exchange item/s of your choosing or a Kōdō credit code. Please note that you are responsible for all applicable shipping charges. 

6. All returns and exchanges are subject to our terms and conditions.
Kōdō is not responsible for and will not accept the return of any item that is not returned in a new and unused condition. All returns must be authorised by Kōdō Customer Service.

SALE ITEMS
Please note that Kōdō does not accept returns on sale items.

Kōdō Competition Terms and Conditions

1. Introduction

1.1. These Terms and Conditions apply to the Kōdō Competition (the "Competition") organised by Kōdō (referred to as "we," "us," or "our").

1.2. By participating in the Competition, entrants agree to be bound by these Terms and Conditions. Failure to comply with these Terms and Conditions may result in disqualification from the Competition.

2. Eligibility

2.1. The Competition is open to individuals who meet the following criteria:

Must be 18 years of age or older.
Must be a resident of Australia

2.2. Employees, immediate family members, or anyone connected with Kōdō are not eligible to participate in the Competition.

3. Competition Period

3.1. The Competition starts on the date of this announcement and ends on December 25, 2023, at 11:59 PM (PST).

4. How to Enter

4.1. To enter the Competition, participants must sign up for the Kōdō email mailing list on the Kōdō website before the closing time of 11:59PM on December 24, 2023.

4.2. Entrants are responsible for providing accurate and up-to-date contact information during the sign-up process.

4.3. Only one entry per person is allowed.

5. Prize

5.1. The prize for this Competition is a Candle and Diffuser Gift Set valued at $179 and includes free shipping within Australia only.

5.2. The prize is non-transferable and cannot be exchanged for cash or an alternative prize.

5.3. The winner is solely responsible for any additional costs, taxes, or expenses associated with accepting and using the prize.

6. Winner Selection

6.1. The winner will be selected through a random draw from all eligible entries received.

6.2. The draw will take place on January 2, 2024.

6.3. The winner will be notified via email using the email address provided during the sign-up process. If the winner cannot be contacted within seven (7) days after the draw, a new winner will be selected.

7. Data Protection

7.1. Personal information provided during entry will be used in accordance with our Privacy Policy. By entering the Competition, participants consent to the use of their personal information for these purposes.

8. General Terms

8.1. We reserve the right to modify, suspend, or terminate the Competition at any time without notice.

8.2. We reserve the right to disqualify any participant who does not comply with these Terms and Conditions or who engages in any fraudulent or unethical behaviour.

8.3. The decision of the competition organisers is final, and no correspondence will be entered into regarding the outcome of the Competition.

8.4. These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States.

Instagram Competition Terms and Conditions

These Terms and Conditions apply to the Kōdō Instagram Competition (the "Competition") organised by Kōdō (referred to as "we," "us," or "our").

1. Eligibility:

The Instagram competition hosted by Kōdō (the "Competition") is open to residents of Australia only.

2. Competition Period:

The Competition begins on 11 November 2023 and ends on 10 December 2023 (the "Competition Period"). The winner will be announced on 11 December 2023 and the prize will be dispatched once winner confirms delivery address.

3. How to Enter:

To participate in the Competition, entrants must:
Follow the official Kōdō Instagram account (@kodo_atelier).
Like and save the official competition announcement post on the Kōdō Instagram page @kodo_atelier.
Tag three friends in the comments section of the competition announcement post.
For additional entries: Post a picture of your Kōdō products on your Instagram profile, tag @kodo_atelier to receive extra entries.

4. Prize:

The prize includes four candles of Kōdō's new fragrances, including KANBI, YOIN, KŌKI, and IPPUKU.
Free shipping within Australia is included.
The prize is non-transferable and cannot be exchanged for cash or an alternative prize.
The winner is solely responsible for any additional costs, taxes, or expenses associated with accepting and using the prize.

5. Winner Selection:

The winner will be randomly selected from eligible entries.
The winner will be contacted via Instagram private message. It is the responsibility of the winner to respond within 72 hours to claim the prize.

6. Privacy:

By participating in this Competition, you acknowledge and agree that your Instagram username and profile information may be used by Kōdō for the purpose of contacting the winner and prize delivery.

7. Publicity:

By entering this Competition, you grant Kōdō permission to use your name and Instagram profile information in promotional materials related to the Competition.

8. General Terms:

This Competition is not endorsed, sponsored, or administered by Instagram. You are providing your information to Kōdō and not to Instagram.
Kōdō reserves the right to cancel or modify the Competition or these Terms and Conditions at any time without prior notice.
Kōdō is not responsible for any technical issues, including but not limited to Instagram outages, that may affect the entry process.
The Competition is subject to all applicable laws and regulations.
